Two Premier Heads Plead No Contest

On February 19, 2010 Premier Medical Management Systems, Inc. executives David Wayne Fish, 47, of San Diego and Birger Greg Bacino, 50, of Rancho Santa Fe, entered no contest pleas in Los Angeles County Superior Court to felony criminal charges related to a seven year investigation spearheaded by HSSP co-founder Clifford D. Sweet, III.  The pleas follow the dismissal last September of $60 million in medical bills and liens submitted to workers’ compensation insurance companies by Premier of Los Angeles.  Fish and former attorney Bacino are scheduled for sentencing before Superior Court Judge Larry Fidler next June.

Representing Insurance Company of the West, Explorer Insurance and The Travelers Companies, HSSP alleged Premier’s bills were the product of a complex “pay to play” referral network generating fraudulent bills for services never rendered.  In court documents, HSSP claimed Premier was unlawfully practicing medicine, engaging in illegal fee-sharing, illegally referring business and fabricating medical charges.
