Premier Lien Claims Properly Dismissed

On February 10, 2011 Associate Chief Judge Mark Kahn issued Findings of Fact and Orders in the Premier Consolidation.  Judge Kahn held that the liens of the Premier Defendants were properly dismissed.

The California workers’ compensation industry owes a tremendous debt of gratitude to lead defendants ICW Group and Travelers for spearheading this long hard seven year fight.  Instead of settling Premier’s bogus claims, they stayed the course to ultimate victory.

It’s gratifying to have been able to work with ICW and Travelers for this victory.  These companies were committed to nothing less than complete dismissal of Premier’s fraudulent bills, liens and charges. 

After seven years and this long fought battle the legal system got it right and justice prevailed.

One way or another all California employers will benefit from this decision.  Not only is there the obvious tangible cost savings gleaned from dismissal of Premier’s $70 million sham charges but also the Court sent a warning that medical provider fraud will be not be tolerated in California’s workers’ compensation system.
