Double Whammy To Rating System

On February 3, 2009 WCAB issued 2 massive en banc decision both covering different aspects of the rebuttal of the 2005 or AMA Guides based Permanent Disability Rating Schedule (PDRS).  Each case attached a different aspect of the rebuttal of the PDRS.

 

The WCAB engaged in a two-pronged attack on the PDRS:

The Almaraz case allows a party to rebut the WPI and substitute in a new starting level of PD to be adjusted in the schedule.  [Click for further details]  

The Ogilvie case allows the parties to customize the adjustment factor for loss of future earnings capacity.  [Click for further details].

 

Neither decision is yet final.  However, they are presently binding on all District Offices of the WCAB.  Hopefully both will be overturned by the Court of Appeal.  If not, all predictability will disappear from the rating system in favor of dueling experts.
