Labor Code section 4600 ties the rate payable for mileage reimbursement for medical and medical-legal expenses to Government Code section 19820 and the Department of Personnel Administration regulations. These, in turn, are linked to the Internal Revenue Service (IRS) published mileage reimbursement rate. As a result we have had wild fluctuations in mileage reimbursement rates over the past 5 years. When computing mileage remember the rate is dependent on the date the travel took place, not the date payment is made regardless of the date of injury.
