Significant Panel Decisions
“In July 1997, the Board announced it had adopted a policy of releasing for publication certain decisions of its three-member panels which it believed were of significant interest and importance to the workers' compensation community. In adopting this policy, the Board stated its intention that publication of these significant panel decision would augment the body of appellate court opinions and of en banc decisions issued by the full Board.
The decisions designated to be "significant panel decision" must meet certain criteria. They must present issues which the Board believes are of general interest, particularly new or recurring issues about which there is little or no published case law. Also, although each significant panel decision is signed only by its three panel members, each significant panel decision must be reviewed by all Board members, and all Board members must concur that the decision is significant and that it merits general dissemination to the workers' compensation community. Finally, the Board and its staff make a particular effort to ensure that its significant panel decisions are thoroughly deliberated and carefully researched.”
