Governor Signs SB 899 Rollbacks:

Two of the biggest impacts of SB 899 were the caps placed on temporary disability and physical medicine.  On October 13, 2007 Governor Schwarzenegger signed into law two bills which lighten these caps and perhaps the signal his willingness undo many of the changes imposed by his sweeping "reform" act.

 

  1. AB 338:  Coto:
  2. Amends Labor Code section 4656 for dates of injury on or after January 1, 2008.  The amendment provides temporary disability shall not extend for more than 104 compensable weeks within a period of five years from the date of injury.

  4. The five year cap for special conditions remains unchanged and is renumbered to subdivision (c)(3).

AB 1073:  Nava:

Amends Labor Code section 4604.5, subdivision (c)’s limits on physical medicine by adding a new subdivision (3) which reads makes the 24 visit cap inapplicable to "postsurgical physical medicine and postsurgical rehabilitation services provided in compliance with a postsurgical treatment utilization schedule established by the administrative director pursuant to Section 5307.27.”
