Court of Appeal Affirms Benson

Benson v. Workers’ Comp. Appeals Bd. (2009): In a not surprising decision the First Appellate District has upheld the WCAB’s en banc decision in Benson v. The Permanente Medical Group. The effect of the decision is to once again affirm that the Wikinson Doctrine is dead.
