Cruz v. Mercedes-Benz of San Francisco (2007) 72 Cal. Comp. Cases 1281: The WCAB unanimously rejected the argument that removal of bone as part of a surgery constituted an “amputation” within the meaning of Labor Code section 4656 triggering the 240 week/5 year cap on temporary disability.
In reaching its decision, the Board determined that an amputation requires the removal or severance of a limb, part of a limb or other body appendage (including surgical removal). The amputation must be of an external projecting body part and cannot be an internal part, even a bone.
Opinion issued September 5, 2007 by WCAB.
