IDL Equals TD For Purpose of TD Cap

Brooks v. Workers’ Comp. Appeals Bd. (2008) 161 Cal.App.4th 1522 [73 Cal. Comp. Cases 447]:  The Court of Appeal, Fifth District has upheld the determinations of the trial judge and WCAB by holding that Industrial Disability Leave (IDL) payable to state employees under the Government Code falls within the ambit of the limitation on aggregate temporary disability payments in Labor Code section 4656.

The holding of this case (IDL counts as TD for the purpose of the TD cap) although limited in scope signals (along with the recent Foster decision) the intention of the WCAB and Court of Appeal to continue the pattern of narrowly construing SB 899 in general and Labor Code section 4656 in particular.
